The Eviction Process The easiest way to start the process of evicting a commercial tenant is to file for a Possession Claim from the County Court. The Government has an online Court and Tribunal Finder and youll need to find the court which is closest to the commercial property itself.
A landlord can use a 30 day-notice to end a month-to-month tenancy if the tenant has been renting for less than a year. A landlord should use a 60-day notice if the tenant has been renting for more than one year and the landlord wants the tenant to move out. (CCP Section 1946.1.)
All month-to-month tenancies must be terminated with 30 days notice if the tenant was on the property for less than a year and 60 days notice if the tenant has rented for one (1) year or longer.
To be valid, the three-day notice must be written and include the following information: date the notice was served on the tenant(s) name(s) and address of tenant(s) the reason for the notice (that the tenant failed to pay rent for a specified period of time)
Notice to Leave Premises Provides the tenant with three (3) days notice to vacate the premises after failing to pay rent or other non-compliance with the lease. Notice to Terminate Tenancy Landlords may serve this notice upon monthly tenants to notify them that their tenancy will expire in thirty (30) days.
Notice (form COCV 1121) must state that the tenant has three (3) business days to pay rent or vacate the premises listed. The three (3) business days excludes Saturday, Sunday and observed legal holidays, per Florida Statute 683.01. Do not count the date the notice was given.
TERMINATION OF TENANCY - If you are a month-to-month tenant, either you or the landlord may end your tenancy by giving the other at least 30 days prior notice. If you are a week-to-week tenant, either you or your landlord may end your tenancy by giving the other at least seven days prior notice.
Each Notice starts with a number of days, like 15-day or 30-day. The number of days is the deadline. You start counting the day after you get the Notice. For the Notices that ask you to pay or fix a problem or move out, you do not count weekends or court holidays in the deadline.
