A section 21 notice gets its name from the section of the Act of Parliament that created it. You may also hear it called an eviction notice, a notice to quit or a notice seeking possession. Using a section 21 notice means a landlord doesnt have to give any reason for asking you to leave.
A landlord can legally evict a tenant only by sending a written notice to the tenant. This written notice must be in the form of a written notice to quit or leave which is a legal document. Eviction for not paying rent, damages to the property or danger to the health or safety of others require seven days notice.
What are the contents of a notice to quit? A notice to quit names the people ordered to vacate the premises, the leaving date, the total sum of unpaid rent, any problems that need to be remedied, the period covered by the accrued amount, and information as to who the vacated property should be surrendered.
You should say something like: I am giving 1 months notice to end my tenancy, as required by law. I will be leaving the property on (date xx). I would like you to be at the property on the day I move out to check the premises and for me to return the keys.
The landlord must serve the tenant a written notice allowing three days, excluding weekends and legal holidays, for the payment of the rent or vacating of the premises. If the tenant does not pay the rent or vacate, the landlord may begin legal action to evict.
The notice must include the specific day that the tenancy will end. There is no designated way to give the notice to quit to the tenant. A landlord can give the notice directly to the tenant in person, but its recommended that a disinterested person be present for this.
Please accept this letter as three weeks notice of my/our intention to vacate the property at [your address] on [date], as required by clause 88 of our tenancy agreement. I/we will be vacating the above premises and returning the keys on [date].
The Section 21(4)(a) Periodic Notice can be served at any time after the fixed term has ended but MUST be served on the tenant or the person lodging the deposit AFTER any deposit taken has been protected and the prescribed Deposit Notice (s213 notice) has been served.
