Essentially, gifts are neither taxable nor deductible on your tax return. Also, a monetary gift has to be substantial for IRS purposes In order for the giver of the sum to be subject to tax ramifications, the gift must be greater than the annual gift tax exclusion amount.
Report the gifts on Schedule A: Computation of Taxable Gifts. Here, youd provide information such as a description of the gift, the recipient, and its value at the time it was made. You may also report transfers subject to the gift tax and/or generation-skipping transfer tax if applicable.
The primary way the IRS becomes aware of gifts is when you report them on form 709. You are required to report gifts to an individual over $15,000 on this form. This is how the IRS will generally become aware of a gift.
Form 709 is an annual return. Generally, you must file Form 709 no earlier than January 1, but not later than April 15, of the year after the gift was made. However, in instances when April 15 falls on a Saturday, Sunday, or legal holiday, Form 709 will be due on the next business day.
Use Form 709 to report: Transfers subject to the federal gift and certain generation-skipping transfer (GST) taxes.
IRS Form 709 Filing Requirements Generally, Form 709: U.S. Gift (and Generation-Skipping Transfer) Tax Return is required if any of the following apply: An individual makes one or more gifts to any one person (other than his or her citizen spouse) that are more than the annual exclusion for the year.
In tax year 2022, gifts exceeding the annual exclusion of $16,000 will trigger the gift tax. Tax would be owed on any amount over $16,000. The giver of the gift is required to file Form 709. For 2023, the annual exclusion is $17,000.
