Common law marriage, also known as marriage without formalities or informal marriage, is a valid and legal way for a couple to marry in Texas.
Every state has its own rules on what you can and cant do regarding name changes after marriage. In most states, you have the option to take your spouses last name, hyphenate your last name, use two last names without a hyphen, or move your maiden name to your middle name and take your spouses last name.
Apply for your marriage license and tell the county clerk that you would like to hyphenate your and your spouses last names. If your marriage license requires you to enter your post-marriage name, make sure to write in your desired hyphenated last name.
Changing your name in Texas requires going to court, except in a few situations. If you get married or divorced in the state, you can change your name without filing a separate name change petition. You can simply change your name in your marriage license or in your divorce decree.
In the state of Texas, to have the capacity to enter into a common-law marriage, you must be members of the opposite sex, you must both be at least 18 years of age or older, you cannot be related, and you must not be currently married to someone else.
Can you change your last name without getting married? As outlined above, definitely yes! The most common reason youre not legally allowed to change your name is if its to defraud someone. Its important that you consult with a lawyer before starting the name change process.
A name change is not required by law, but a person may decide to take their spouses last name when they get married. State law does not contain step-by-step instructions when changing your last name after marriage. There is no single legal form to fill out.
One or both partners can change their middle or last names on the Declaration of Domestic Partnership form as part of the registration. Information concerning this name change process can be found in California Family Code sections 298, 298.5 and 298.6.
