A Revocation of Power of Attorney (also known as a Deed of Revocation) is a legal document signed by or on behalf of a person who granted a power of attorney (the donor). It states that the donor is canceling the powers that were given to another person (the attorney) in an earlier power of attorney.
Can You Amend A Power Of Attorney Document? Yes, you can amend a Power of Attorney document. However, making big changes such as removing named attorneys or replacing an existing attorney with another actually happens as part of the process of revoking a Power of Attorney.
Removing an attorney You can ask the Office of the Public Guardian ( OPG ) to remove an attorney if your lasting power of attorney ( LPA ) is registered and you still have mental capacity to make decisions. You will need to send OPG a written statement called a partial deed of revocation.
If a registered PoA is to be revoked i.e. cancelled, you (the granter) will need to send: A statement explaining your wishes and.Amending a power of attorney (PoA) Removing power(s) from the PoA. Add an attorney, this could either be a joint or a substitute attorney. Adding in power(s) or. Amending powers.
Ultimately the Office of Public Guardian (OPG) or the Court of Protection can remove a power of attorney in the UK.
You will need to provide us with a revocation notice which clearly states what your intentions are and what you wish to cancel / revoke. Please remember to tell us about the PoA your revocation applies to. The revocation notice can be typed or handwritten and must be signed and dated by you i.e. the granter.
A donor, with the mental capacity to act, can revoke a lasting power of attorney (LPA) by sending a revocation notice to the attorney(s) and the Office of the Public Guardian (OPG).
One needs to draw a distinction between power of attorney and guardianship (called deputyship under the MCA) as the rules are quite different. A Scottish PoA can be used in England or Wales if an Organisation (e.g. a bank) accepts its authority, but if they do not things are more problematic.
