The purpose of the Mechanics Lien Act is to ensure that contractors and subcontractors who provide labor, materials, fixtures, or machinery to improve real estate receive payment for their services and materials.

A mechanics lien transaction in violation of these provisions of the Illinois Compiled Statutes will be returned.
All persons who, at the request of the owner or owners agent, furnish labor, material, leasing equipment, special skills, or other necessary services to a project for constructing a work of improvement on real property are entitled to a mechanics lien unless they come within a statutory or case law exception.
A general contractor mechanics lien claimant must establish: (1) a valid contract; (2) with the owner of the property or someone authorized to contract on behalf of the owner; (3) for the furnishing of services or materials; and (4) performance of the contract or a valid excuse for non-performance.
