Both parents are entitled to at least 4 months leave each. As a general rule, employees cannot transfer their leave entitlement to the other parent. However, some countries may allow them to transfer part of their entitlement, but no more than 3 months.
Most OECD countries pay for parental leave programs using social insurance funds that are supported by employer, worker, and government contributions. Some countries fund parental leave through general taxes or health insurance.
All European countries offer a form of leave to be taken by mothers and, because of each countrys own legislation, the length of the leave and the pay rate varies. In most EU countries, to be eligible for maternity allowance a woman must have worked enough hours or paid social security contributions.
Japan 52 weeks or more In Japan, mothers and fathers are each entitled to up to a year of paid parental leave after the birth of a child.
International minimum standards In the European Union, the Pregnant Workers Directive requires at least 14 weeks of maternity leave; while the WorkLife Balance Directive requires at least 10 days of paternity leave, as well as at least 4 months of parental leave, with 2 months being non-transferable.
Currently, 119 countries meet the ILO standard of 12 weeks with 62 of those countries providing for 14 weeks or more. Just 31 countries mandate a maternity leave of less than 12 weeks.
Besides the United States, the only other countries with no national paid maternity leave are the Marshall Islands, Micronesia, Nauru, Palau, Papua New Guinea and Tonga.
For mothers, a new law will enter in force on 1 April 2022 and provide for leave of 60-100 days; the rest (40 days) will be added to parental leave.
