Rescission is when a contract is rendered null and void, and so is no longer recognized as legally binding. The courts can free non-liable parties from their agreed obligations and, when possible, will effectively seek to restore them to the position they were in before the contract was signed.
The right of rescission is a legal protection under the Truth in Lending Act (TILA) that allows you to cancel certain mortgage agreements within three days without any financial penalties.
To have a contract rescinded, a judge must determine that there is a valid reason to undo the contract. Since a contract is a legally binding agreement between two parties, it cannot be rescinded because the parties have simply had a change of mind.
Civil Code 1689(b). An agreement may be rescinded if the rescinding partys consent is based on a mistake or misunderstanding of facts or law and the other party either shares the misunderstanding or contributes to it by misrepresentation, even if innocently.
Cancellation is a term often used interchangeably with Rescission, but whereas only a document can be cancelled, any agreement - whether oral or written - can be rescinded.
Courts will often order rescission when a contract dispute results in a civil lawsuit. The idea is that rescinding the contract will place the two parties as close as possible to the position they would have been in had they not formed a contract.
The lender has to refund any fees youve paid for your loan, including application fees and home appraisal fees that you may have paid up front. Also, you have to return any funds youve received. Once you rescind, the transaction is void.
