If an employee fails a drug test through DISAs program, it will remain on their account indefinitely. Depending on the industry and/or workplace policy, employees have the opportunity to complete a Return-to-Duty test and process.
Employees must report to work fit for duty and free of any adverse effects of illegal drugs or alcohol. The Company permits the legal use of prescribed drugs on the job if they do not impair your ability to perform the essential functions of your job effectively and safely without endangering others.
The Clearinghouse contains records of violations of drug and alcohol prohibitions in 49 CFR Part 382, Subpart B, including positive drug or alcohol test results and test refusals. When a driver completes the return-to-duty (RTD) process and follow-up testing plan, this information is also recorded in the Clearinghouse.
After you complete the DOT SAP process, the employer schedules you for an observed return to duty test. The employer reports the results of the follow-up test result along with the first and last dates of your follow up testing plan. Your record stays in the Clearinghouse for five years.
How Long Do Failed Drug Tests Stay on Record? The positive drug test remains in the Drug and Alcohol Clearinghouse until you successfully complete the RTD process and the observed DOT follow-up testing. After that, the information stays in the Clearinghouse for five years.
Under My Dashboard, go to Violations and access your Violation History. Locate the violation and click View Violation Details. Click Request to Remove Violation FMCSA will review the request and, if approved, remove the violation from the Clearinghouse.
