Below are some common questions from our customers that may provide you with the answer you're looking for. If you can't find an answer to your question, please don't hesitate to reach out to us.

In the case of a simple agreement, the document should be dated with the date on which the last party signed it. If the parties signed on different dates, the agreement should be dated with the date of the last signature to be added.
Additionally, a deed doesnt necessarily have to be dated to be effective, just delivered. The dating of a deed is usually evidence of when it took effect but a deed becomes effective when it is delivered, even if it is not actually dated!
It depends whether the document in question is a simple agreement or a deed. In the case of a simple agreement, the document should be dated with the date on which the last party signed it. If the parties signed on different dates, the agreement should be dated with the date of the last signature to be added.
Altering documents after signing can lead to numerous consequences. Faking a signature without permission, making a false document, or changing an existing document are all considered to be a forgery. Forgery is a crime and punishable by law.
4. What date should be inserted into the deed? Where a deed contains wording stating that it is executed and delivered on the date appearing at the head of the document, as recommended above, then a date should be inserted that is on or after the date that the last signatory signed.
For execution as a deed the requirement of signing is a crucial part of the process of creating rights by way of deed, and so it is never permissible to backdate a deed.
If the person who signed it did not date the signature, the contract becomes active when the agreement leaves his or her hands. However, if the contract includes an effective date, the contract becomes valid from the stated date, and not when the signatures are dated.
You should never backdate a document that adversely impacts the rights of a third party or violates the law. This is even if there was no intentional ill will. You should also never backdate a contract to memorialize a prior act unless you are absolutely certain the act actually occurred on that specific date.
