Maternity leave refers to the period of time that a new mother takes off from work following the birth of her baby. Many companies have similar policies for fathers, which allow for paternity leave.
There are three main types of pay that an employee can receive during their maternity leave: Statutory Maternity Pay, Occupational Maternity Pay and Maternity Allowance.
The Family and Medical Leave Act (FMLA) provides certain workers job-protected leave when they take time off work for the birth, adoption, or foster care placement of a child and to bond with the child.
Statutory Maternity Leave Eligible employees can take up to 52 weeks maternity leave. The first 26 weeks is known as Ordinary Maternity Leave, the last 26 weeks as Additional Maternity Leave. The earliest that leave can be taken is 11 weeks before the expected week of childbirth, unless the baby is born early.
Maternity leave is time off, either paid or unpaid, to care for yourself after childbirth and to bond with a new child. Federal or state laws may protect your job while you are taking leave due to pregnancy, recovery from childbirth, or to bond with a new child (including adopted and foster children).
If you want to change the start date of your maternity leave, you must give your employer 28 days notice, or agree a new date together.
Dear [Name], This letter is to inform you that I am pregnant and plan to take maternity leave. My due date is [date] and I plan to continue working until [date or suggest working from home until your due date or delivery]. I plan to take [number] weeks of maternity leave.
You can start your maternity leave any day from 11 weeks before your due date.
