Generally, only public employers are required to pay for any part of military leave. Private employers may grant annual leave with or without pay and may pay for all or part of the leave. In the case of active duty leave, the employer may adopt a policy of paying the difference between civilian pay and military pay.
Annual Leave: Active duty Soldiers earn 2.5 days of annual (chargeable) leave for each month of service, for a total of 30 days per year. Currently, Soldiers can bank up to 60 days of leave at the end of the fiscal year.
Transitioning members may sell back any unused leave. Members are authorized to receive a cash payment for any unused leave when they separate from the military if they are retiring or separating with an honorable discharge. You can also take what is known as terminal or separation leave when you are being discharged.
The state provides 30 calendar days of state pay per fiscal year for active military duty to an employee who qualifies based on Government Code sections 19775 or 19775.1. On the 31st calendar day, the employee becomes eligible for the provisions of Government Code section 19775.17 for up to 180 calendar days.
The employees timekeeper should use Transaction Code 68, on the employees time and attendance report to pay the employee for the 22 days of military leave. Holidays and non-duty weekends do not count against the 22 day emergency military leave ceilings.

5 U.S.C. 6323 (a) provides 15 days per fiscal year for active duty, active duty training, and inactive duty training. An employee can carry over a maximum of 15 days into the next fiscal year.
