Personal guarantees can be used for business or personal loans; but in both cases, these guarantees create broader liability for borrowers and co-signers to repay loans.
A cross guarantee refers to an arrangement between two or more related companies to provide a guarantee to each others obligations. Such a guarantee is commonly made among companies trading under the same group or between a parent company and its subsidiaries.
Bankruptcy can eliminate a personal guarantee on both business loans and personal loans. Guarantees on Business Loans: Its relatively common for a business owner to file individual bankruptcy to get rid of a personal guaranteeand most personal guarantees will qualify for discharge.
The difference between corporate and personal guarantors is quite simple: a personal guarantor is an individual who agrees to take on the obligations of a debt for a debtor, whereas a corporate guarantor is a corporation that takes on payment responsibilities.
If the bank will not release the personal guarantee, alternatives are to pay off or refinance the business loan. The first thing to do is to speak to your bank about getting released from the personal guarantee. They are very likely to simply say no, so you will need a great argument to convince your bank that the loss of a personal guarantee does not increase the risk of non-payment of your business loan.
