An assumption agreement, sometimes called an assignment and assumption agreement, is a legal document that allows one party to transfer rights and/or obligations to another party. It allows one party to assume the rights and responsibilities of the other party.
Most importantly, an alienation clause prevents the homebuyer from assuming the mortgage. Without this clause, the buyer could assume the existing mortgage and repay it at that interest rate, rather than obtaining a new loan at prevailing rates.
For example, if you are purchasing a home for $200,000 and the seller has a $100,000 assumable mortgage, you will still have to obtain a mortgage for the balance or pay the difference in cash. Assumption clauses generally include a fee to transfer the mortgage from one borrower to another.
Lenders must approve an assumable mortgage. If done without approval, sellers run the risk of having to pay the full remaining balance upfront.
Keep in mind that the average loan assumption takes anywhere from 45-90 days to complete. The more issues there are with underwriting, the longer youll have to wait to finalize your agreement.
To assume a loan, the buyer must qualify with the lender. If the price of the house exceeds the remaining mortgage, the buyer must remit a down payment that is the difference between the sale price and the mortgage. If the difference is substantial, the buyer may need to secure a second mortgage.
A mortgage is considered assumable if the loan agreement allows the original borrower to transfer their loan to someone else. In this case, the buyer of the home would simply take over the sellers existing loan, and the current rate, terms and balance would stay the same.
You can transfer a mortgage to another person if the terms of your mortgage say that it is assumable. If you have an assumable mortgage, the new borrower can pay a flat fee to take over the existing mortgage and become responsible for payment. But theyll still typically need to qualify for the loan with your lender.
