A notice to quit is a document from a landlord or owner notifying a tenant that they need to leave the rented premises. Notices of this nature give a tenant a specific date to vacate and settle unpaid rent or rectify other concerns which violate the terms of the lease.
Landlords can evict tenants under the following circumstances: The tenant did not pay rent, the landlord made a demand for rent and waited 10 days, but the tenant still has not paid the rent. The lease has ended, but the tenant has not moved out. The tenant has violated a condition of the lease allowing for eviction.
This process can take several weeks. Most landlords use county court bailiffs. Some use hight court bailiffs, also known as high court enforcement officers (HCEOs). Bailiffs and HCEOs must give you at least 2 weeks notice of the eviction date.
What is a section 21 notice? If you have an assured shorthold tenancy, then a section 21 notice is the most common way of starting the eviction process. Giving you notice is how your landlord tells you that they want you to leave their property and the date they want you to leave by.
Youre responsible for rent until the tenancy ends, even if you move out earlier. Your landlord should be flexible if they want you to leave without court action.
If you dont pay your rent, your landlord could take you to court to get back any unpaid rent you owe. They could also refuse to give you a reference or give you a bad one, which could make finding another home difficult.
Your landlord can start the eviction process straight away if you miss a payment and any of the following have happened: youve been late with rent before. youre already in arrears with your rent. the fixed term period of your tenancy has ended - if your tenancy is an assured shorthold tenancy.
