Pay (cash) in lieu of benefits Some companies provide pay in lieu of benefits, which is where an employee opts out of receiving and participating in benefits, such as health and dental, in return for cash.
Payment in lieu of notice allows an individuals employment to be terminated immediately without them needing to complete or work their notice period. Instead, the employer pays the exiting employee the amount they would have earned had they worked their full notice period.
In lieu means in place of or instead of in French, so you receive pay instead of working during that period. For example, if an employee has a three month notice period, the employer might decide that they want today to be the last day of your employment.
A payment in lieu will include payment for holiday entitlements if the employee has them. PILON can either be set out in the contract as an option for the employer, or it may simply be paid to cover any potential damages for bdocHub of contract.
The party that fails to provide the notice is required to pay the other party an indemnity in lieu of notice. The quantum is one days wage for each day of the required notice period. If the party has given insufficient notice, the same calculation applies for the number of days falling short of the required period.
