First, the employer has to calculate PENP. The PENP is the amount of basic pay that an employee would have earned for the notice period to which they were entitled, less any period of notice worked.
For example: Your companys policy for the notice period is 30 days. You submitted your resignation on 1st September. Then your Last Working Day(LWD) is 30 days from the date of your team members resignation submission, i.e., 30th September.
How Is PILON Generally Calculated? Paying PILON should be easy simply pay the employee what they would earn during their standard notice period. If a PILON clause is included in the contract, gov.uk says, Your employer will pay you instead of giving you a notice period.
PENP is, broadly, the basic salary the employee would have received during any unworked period of notice minus any contractual or deemed PILON.
PILON stands for Payment In Lieu of Notice. It is a payment made to an employee when dismissed instead of the individual having to work their notice period.
-subtract the amount paid on termination (excluding holiday pay, bonuses and consideration for restrictive covenants) which have already had income tax and NICs applied (e.g. any contractual PILON payment to be made). The resulting figure is PENP. If PENP is zero or a minus number then no additional tax will be due.
The termination date is calculated from the day you give the notice, and the day before the same day of the next month. For example, if you give the notice on July 6, then his last day should fall on September 5. If the notice period is not provided, the employer needs to give the payment in lieu of notice!
How is pay in lieu of notice calculated? Pay in lieu of notice is calculated by using what an employee would have earned if they had physically worked their notice period, for example, one week or one months notice would be the same as one week or one months pay.
