The name and address of the person who signed the affidavit (the Affiant) An acknowledgment the Affiant is of legal age. The name of the decedent. The date of the decedents birth and death.
The laws of intestate succession generally favour the spouse, children and grandchildren, and then move to parents and grandparents and to brothers and sisters. In Jamaica, the law which deals with intestate estates is the Intestates Estates and Property Charges Act.
The process involves applying to the Supreme Court of Jamaica for the grant of probate and the following documents are required: Certified copy of the death certificate of the deceased; The original of the last will and testament of the deceased (if you cannot find the original, a copy can be used. Oath of executor.
As mentioned above, if there is a surviving spouse the child or the children share only in a portion of the estate. However, if there is no surviving spouse, the children are entitled to the entire residuary estate.
