Leaseholders who own flats can either extend their leases under the law if they meet certain criteria (formal route), or by asking the freeholder to see whether they are willing to negotiate a lease extension informally (informal route).
Leasehold Extension - Getting Started If you have owned the flat for at least two years then you have the right to buy an extra 90 years to add to what is left on your existing lease. For example, if you have 75 years left on your lease you will be given a new lease of 165 years.
There are two ways to get a lease extension: The first is to serve a notice claiming your legal right, known as a statutory or formal lease extension. The second is to simply agree a deal with your freeholder, known as an informal lease extension.
This is calculated as the amount of ground rent the landlord would have received for the remaining period of the existing lease (the term) and the extra 90 years the landlord will have to wait until ownership of the property will return to them (the reversion value).
You may use the mathematical formula to calculate the monthly lease payments. PMT = PV FV / [(1+i)^n / (1 (1 / (1+i)^n / i)] For example, the cost of the leased asset is Rs 2,00,000. The residual value is Rs 50,000. The rate of interest is 8%.
It is usually calculated as a percentage (5-10%) of the income from the land and any buildings. Generally, this is increased periodically (every 5-21 years), to fit in line with market rental levels.
A Section 42 Notice is a formal request from a leaseholder to the freeholder or landlord (or both) and any other appropriate party to extend their lease on a property. This provides a leaseholder with an extension of 90 years on top of the remaining lease term and a ground rent reduced to zero.
