What is an arbitration agreement? Arbitration agreements require that persons who signed them resolve any disputes by binding arbitration, rather than in court before a judge and/or jury.
Example 1. Arbitration. All claims and disputes arising under or relating to this Agreement are to be settled by binding arbitration in the state of [insert state in which parties agree to arbitrate] or another location mutually agreeable to the parties.
A person called an arbitrator listens to each side and decides how to resolve the dispute. In the past, mortgage lenders would sometimes include mandatory arbitration clauses in mortgage agreements. These clauses made you agree to resolve certain types of disputes in arbitration rather than in court.
