Generally, copyrights protect creative works, and trademarks apply to brand names, phrases, and logos. Copyrights primarily protect the rights of people who create literary, dramatic, musical, artistic, and certain other original works (like history tests, and software code).
A brand licensing agreement is a legal contract between a branded company selling the use of their imagery, logo, or what is called marks to another company. This agreement allows a company to use a logo or other trademarks in marketing products or services without infringing on a copyright.
You may conduct a free online search of the USPTO database at the Public Search Facility (Madison East, 1st Floor; 600 Dulany Street, Alexandria, Virginia) between 8:00 a.m. and 8:00 p.m. USPTO personnel may not conduct trademark searches for the public. Private trademark search firms will conduct searches for a fee.
How to Trademark a Logo. A unique logo can be trademarked by registering it with the USPTO. Anyone can apply online on the USPTO website if the business for which theyre authorized to file is principally located inside the U.S. If based outside the U.S., a patent attorney will be required to make the filing.
Is a logo subject to copyright? Yes. A logo that includes artistic or design elements, (i.e. not just the name on its own), is legally regarded as being a work of artistic creation and therefore will be protected under copyright law.
Logos dont even need to be registered as trademarks to be protected under current law. This means that using someone elses logo without permission, even if its unregistered, is against the law.
To get permission and avoid trademark infringement, write a letter to the trademark owner. Include a description of why you are asking and how the logo will be used. Third parties should never use someone elses logo without a licensed agreement, including program and corporate logos.
A copyrighted logo is protected as an artistic work. Unauthorized usage of your logo is an infringement of copyright. No one can use any of your original works fixed in a tangible form without your permission.
