Generally, artists collaborate with brands to use famous logos either via permission or through a conditional license. However, there are also numerous examples of artists using well-known trade marks without permission. A great example of this is Andy Warhols famous Campbells Soup artwork produced in 1962.
An artist may incorporate another persons registered trademark in a work of art, provided that the work of art is the original result of a creative design process that is not aimed at damaging the trademark or the trademark owner.
Trademark infringement is prosecuted under civil laws, and is not a criminal act. Instead, lawsuits over trademark infringement will usually require you to stop using the trademark, and you may have to return any profits made off of the infringing use, or pay money damages for the use of the trademark.
You can use licensed brands and logos and SELL that art work. Trademark infringement is when you use someones brand or logo on a product that competes with the original product.
Only the original creator can use any of the characters and nobody else is allowed unless been given permission or you pay royalties. However, many are still selling fan art without permission and get away with it as they do not get too widespread with their work.
A photo release form allows an individual or photographer to obtain consent from the other party in order to use photographs for personal or commercial use. The releasing party, the releasor, can choose to give away the rights to the images for free or charge a fee or royalty.
An artwork release allows a filmmaker the use of a specific work of art, or reproductions of that art, while protecting the owners rights. This includes the terms of how the artwork will be used, and payment for its use.
How to Write a Photo Release Form: Identify the releasor. Describe the photo, image, likeness, or video. Address any payment the model receives for the release. Address royalties. Address whether the model has the ability to revoke their authorization. The parties sign and date the release.
