A patent owner has the right to decide who may or may not use the patented invention for the period in which the invention is protected. In other words, patent protection means that the invention cannot be commercially made, used, distributed, imported, or sold by others without the patent owners consent.
Assignment means a transfer by a party of all or part of its right, title and interest in a patent, patent application, registered mark or a mark for which an application to register has been filed.
In a license agreement, the patent owner gives another entity (the licensee) permission to use the patented technology, while the patent owner retains ownership. In a patent assignment, the original owner permanently transfers its ownership to another entity.
The original owner should record the assignment or name change with the USPTOs Assignment Recordation Branch by filing a Recordation Cover Sheet along with a copy of the actual assignment or proof of name change.
Unfortunately, under United States patent law you can not amend the patent to include the new subject matter reflecting the improvement you made to the invention. You will have to file a new patent application for the improvement to the invention instead of filing an amendment to the patent.
A substitute statement under 37 CFR 1.64 must: (1) comply with the requirements of 37 CFR 1.63(a), identifying the inventor or joint inventor with respect to whom a substitute statement in lieu of an oath or declaration is executed, and stating upon information and belief the facts which such inventor is required to
The assignee is the entity that has the property right to the patent. Patents are property. The inventor and the assignee may be one in the same but an employee will more than likely assign a patent to a company. The assignment of a patent is independent from the inventorship.
