A Section 21 Notice comprises of no more than a couple of sheets of A4 and in essence comprises of 4 bits of information: The name of the landlord. The name of the tenant. The address of the rental property. The date of that the landlord needs their rental property back.
You should say something like: I am giving 1 months notice to end my tenancy, as required by law. I will be leaving the property on (date xx). I would like you to be at the property on the day I move out to check the premises and for me to return the keys.
The Section 21(4)(a) Periodic Notice can be served at any time after the fixed term has ended but MUST be served on the tenant or the person lodging the deposit AFTER any deposit taken has been protected and the prescribed Deposit Notice (s213 notice) has been served.
The Notice to Quit must allow the tenant at least 3 (three) full days to move. This means that there must be 3 (three) full days between the date the Notice to Quit is served on your tenant and the last day specified in the Notice to Quit for the tenant to vacate the premises.
You must receive written notice of the date and time the physical eviction will take place at least 48 hours in advance. On the date set in the 48-hour notice, you must leave apartment. The landlord may use the execution anytime within a three-month period.
If the tenant doesnt move out of the property by the end of the notice period stated in the section 21 notice, you can apply to the county court for an order for possession. This is called making a claim for possession. You must apply to the county court in the area where the property is located.
