Generally, in Illinois, a landlord can evict a commercial tenant for just cause. This means that a landlord must have a legal reason. Eviction of a commercial tenant is an option in Illinois for a landlord when the tenant has violated a term of their commercial lease.
You must give the tenant a minimum of three (3) days notice before eviction for non-payment of rent. Other contract violations require a minimum notice period of fifteen (15) days.
On average, it would take anywhere between 3 weeks to 6 months for a complete eviction process. This does not include any appeals for reconsideration.
The eviction process can take 30 - 45 days, or longer. The time starts from when you have eviction court forms delivered to your tenant to the time they must move out.
On average, the eviction process can take 40 - 90 days after the tenancy or occupants right to possession of the property has been terminated.
AB-1482 does not apply to commercial buildings.
If the tenant is served in person, clearly, the effective date is three days, but if there are other means of service - through the mail, for example - the best practice is to add another five days. If the tenant pays the rent in three days, the matter is done.
