Immediate Jeopardy (IJ) represents a situation in which entity noncompliance has placed the health and safety of recipients in its care at risk for serious injury, serious harm, serious impairment or death.
Immediate jeopardy is a situation in which the nursing homes non-compliance with one or more requirements has caused, or is likely to cause, serious injury, harm, impairment, or death to a resident.
The Minimum Data Set (MDS) is part of the federally mandated process for clinical assessment of all residents in Medicare and Medicaid certified nursing homes. This process provides a comprehensive assessment of each residents functional capabilities and helps nursing home staff identify health problems.
A J tag means that there was a finding that resulted in immediate jeopardy. What was the issue? If a facility gets an immediate jeopardy, then whatever it is/was must be corrected immediately. The facility must present a plan of removal to the survey team usually before the team can leave the building for any reason.
In all cases of immediate jeopardy, the provider agreement must be terminated by CMS or State Medicaid Agency no later than 23 calendar days from the last day of the survey if the immediate jeopardy is not removed.
Immediate Jeopardy can ruin your reputation, lead to hefty fines, and even result in the closure of your facility. Removing the jeopardy tag is known as abating the jeopardy. In order to achieve this, you will need to submit a written Allegation of Compliance that the Immediate Jeopardy has been removed.
