What Should Be in a Construction Contract? Identifying/Contact Information. Title and Description of the Project. Projected Timeline and Completion Date. Cost Estimate and Payment Schedule. Stop-Work Clause and Stop-Payment Clause. Act of God Clause. Change Order Agreement. Warranty.
Choosing the right construction contract for your project depends on several factors, such as the project scope, budget, schedule, quality, risk, and relationship. You should consider the pros and cons of each contract type and how they align with your projects goals and expectations.
Turnkey Contract The contractor is responsible for all aspects of the project, including design, procurement, construction, and commissioning. This type of contract can be beneficial for the owner as they do not need to be involved in the construction process and can focus on other aspects of the project.
Fixed Price Incentive Contracts are preferred when contract costs and performance requirements are reasonably certain. Cost Reimbursement Contract provides the initially negotiated fee to be adjusted later by a formula based on the relationship of total allowable costs to total target costs.
There are five key components you need to address in each construction contract as a protection against legal trouble. Scope of the project. Total cost and payment requirements. Project timeline. Lien law protection. Dispute resolution.
A lump sum contract is an agreement that sets a predetermined cost for construction work. In other words, the contractor performing the work agrees to complete the project for a fixed amount no more or less.
Lump-Sum contracts are the most frequently-used contract, particularly for building construction. The idea is that all aspects of the project are pre-determined and laid out in a fixed scope of work. The cost is known and upfront for the owner, and the contractor is able to manage expectations.
Lump sum contracts (also sometimes known as fixed price contracts) are usually considered the most popular type of contract when it comes to building and engineering agreements, however they do have minor differences.
