In general, when a state contains general law and chartered local governments the general law local governments have less local autonomy and Home rule than do the chartered local governments in the same state. However, the lack of a charter does not always signify the lack of home rule authority.
There are two types of cities in California: charter cities, which possess home rule powers and which may legislate free of interference in matters of municipal affairs; and general-law cities, which are sub ject to the general laws of the state. (See chart at left, How Californias Cities Are Governed.)
Of Californias 478 cities, 108 of them are charter cities. The charter city provision of the State Constitution, commonly referred to as the home-rule provision, is based on the principle that a city, rather than the state, is in the best position to know what it needs and how to satisfy those needs.
The City of Los Angeles is a Mayor-Council-Commission form of government, as defined in the City Charter, originally adopted by the voters of the City of Los Angeles, effective July 1, 1925 and reaffirmed by a new Charter effective July 1, 2000.
There are currently 13 charter counties, including: Alameda, Butte, El Dorado, Fresno, Los Angeles, Orange, Placer, Sacramento, San Bernardino, San Diego, San Francisco, San Mateo, Santa Clara, Tehama. General law counties are governed by the California Government Code.
A charter city is a new city granted special jurisdiction to create a new governance system and enact policy reforms. Charter cities can help improve governance in a limited geographic area by giving local officials authority to implement best legal and administrative practices and commercial regulations.
A General Law City has the authority to act locally but its acts must be consistent with the California Constitution, state statutes, and state administrative regulations. A Charter City adopts a Charter, which is a document that outlines how a city is governed.
A few examples include Los Angeles, San Francisco, San Jos, and the capital, Sacramento.
Cities that have not adopted a charter are general law cities. General law cities are bound by the states general law, even with respect to municipal affairs. Of Californias 478 cities, 108 of them are charter cities.
