When a prospective tenant applies to rent a property as their main home, the landlord or letting agent will ask to see identity documents. Acceptable documents may include a valid passport or a combination of a UK driving licence and a birth certificate.
Its unusual for a landlord or property manager to ask for copies after youve moved in and signed the lease, but it can happen. Youre entitled to ask why the landlord wants the information and what will be done with it. If you dont get a good answer, you can refuse.
Questions a landlord cannot ask Landlords cannot ask you personal questions that interfere with your rights under the Ontario Human Rights Code. Therefore, questions about age, disability, place of origin, religion, family status, sexual orientation, gender expression and other Human Rights grounds are not allowed.
A landlord can ask you about your income, but they must also look at any available information on your rental history, credit references and credit rating (such as through Equifax Canada).
To run a credit check, the minimum information required would be your name, address and date of birth. A landlord may ask for your drivers licence, passport, income, or other document. These are not required for credit checks but may just allow for a more detailed check to be sent to the landlord.
You must give your landlord at least 30 days notice. If you have a daily or weekly tenancy, you must give the landlord at least 28 days notice.
Written notice can be sent by mail or email. But if you tell the collection agency you dont want to receive emails and give them your address, they must send you the written notice by mail. The notice must include things like: the name of the person or business who says you owe them money, also called the creditor.
Protection of Personal Information Its reasonable to expect landlords to ask potential tenants for certain types of personal information like proof of income, references or identification. This information should only be used for completing the application process to verify income or perform a credit check.
