Transactions fees may be charged only under certain conditions, pursuant to G.S. 66-58.12 and G.S. 147-86.22. Agencies desiring to charge consumers a fee (convenience fee), must adhere to the policy established by OSC, including abiding by all Visa and MasterCard association rules.

In North Carolina, a bill would ban any extra charge for card payments and would levy a fine of up to $2,500 for a first-time violation. By contrast, a pending bill in Washington would explicitly allow a transaction fee for processing a credit card payment as long as a no-cost payment option is always available.
While the California Civil Code Section 1748.1 prohibits retailers, including service providers, from imposing surcharges on customers who choose to pay with a credit card, it also allows retailers to offer discounts to encourage payment by cash, check, or other means.
Surcharges are fees that are tacked onto the price of goods and services. Surcharges are either a fixed amount or a percentage of the purchase price. They come in many forms, including service fees, handling fees, disposal fees, and processing fees.
A convenience fee is levied by a merchant for offering customers the privilege of paying with an alternative non-standard payment method. Merchants can process convenience fees in all 50 states. A surcharge is levied by a merchant for customer purchases made with a credit card.
The good news is that while the legality of surcharges has been murky in the past, as of 2023, credit card surcharges are now legal in all U.S. states except for Connecticut and Massachusetts.
You can withhold payment of the amount in dispute and the finance charge on that amount until the card company investigates the dispute. You can also withhold the interest payment on the disputed amount. You must pay the amounts that are not in dispute.
