There are ways to avoid paying stamp duty if the value of the property is within a certain threshold set by the state government and if certain conditions are met, such as being a first home buyer.
Which properties are legitimately exempt from SDLT? A property transferred to you with no payment changing hands. A property transferred as the result of divorce, or the breakup of a civil partnership. Caravans, mobile homes and houseboats. A property purchased for less than 40,000. A property left to you in a will.
If you gift your home to someone else they wont have to pay SDLT on the market value of the property provided there is no outstanding mortgage on the property. If you take over some or all of an existing mortgage, SDLT may be payable on the value of the mortgage over the relevant SDLT threshold.
There is no immediate SDLT saving on purchase. An SDLT saving may arise however when the time comes to sell the property. Rather than selling the property, it is possible to sell the shares in the company thus transferring ownership of the property.
Ways to avoid stamp duty on your second home Buy a caravan, motorhome, or houseboat. If the property is intended to be used by a family member, put the deed and mortgage in their name. Purchase property worth less than 40,000. Purchase a buy-to-let as a first-time buyer.
Stamp duty is a tax that you might have to pay when you buy a property. There are thresholds so if you buy a property that is below a threshold then you wont have to pay stamp duty. On 23 September 2022 the stamp duty thresholds increased, meaning buyers will pay less tax than previously.
UK residents purchasing a primary residence priced at 250,000 or under are exempt from stamp duty from 23rd September 2022. For properties priced over 250,000, some stamp duty will still be paid.
Ways to avoid stamp duty on your second home Buy a caravan, motorhome, or houseboat. If the property is intended to be used by a family member, put the deed and mortgage in their name. Purchase property worth less than 40,000. Purchase a buy-to-let as a first-time buyer.
The best way to avoid stamp duty is to haggle the asking price of the property so that you can avoid a higher tax band but there are other ways to negotiate. For example, if youre buying a new build, the company selling the homes may offer to pay the stamp duty. And if it doesnt offer, you can always ask.
If you cant afford your stamp duty bill, then you do have the option to borrow more on your mortgage to cover the tax bill. You simply need to calculate how much stamp duty you will owe and increase your mortgage borrowing to cover it.
