Leaves of Absence in Canada In Canada, employees may request work leaves - time away from thier jobs to take care of unusual circumstances and other life events. Typical reasons for leave requests include: pregnancy/maternity, parental responsibilities, family emergencies, illness, bereavement and voting.
If an employer refuses an employees legitimate request for a leave, or threatens to fire, intimidates, or punishes the employee for requesting such a leave, you could be entitled to damages, including reinstatement to your position if your employment was terminated.
Paid time off includes sick days, paid vacation, etc. On the other hand, a leave of absence is an unpaid time off requested by employees to deal with special circumstances such as illness in the family or the birth of a child.
Not to be confused with paid time off (PTO) and vacation time, a leave of absence is a way for employees who are experiencing out-of-the-ordinary circumstances to take time off work. Common reasons are childbirth, adoption, caring for an ill family member, serious health conditions or military leave.
However, the total amount of leave taken by all cannot be more than 28 weeks within the 52-week period. You can consecutively take the leave related to critical illness to care for the same person if you are eligible.
A leave of absence letter should include the reason for the request and the amount of time youll need away from work, with the date youll stop working, and when you will return. It should also contain your contact information and, if possible, a plan to keep your team on track without you.
You can request leave without pay for personal needs for either up to 3 months or for more than 3 months but up to one year.
