hey everybody this is attorney Kenneth Stevens from the law firm Stevens PLLC and today Im hoping to clear up some confusion regarding lien deadlines notice deadlines and when the clock actually starts to run for the deadline for falling here lien affidavits now with regard to notice obviously general contractors you dont have to sit notice you can just file your lien with regard to the deadlines to fall liens on commercial projects anyway that that lien has to be followed by the 15th day of the fourth calendar month that seems to be pretty well understood most of you that call me coming to my office kind of have that ideal in mind and youre normally coming in trying to beat that deadline where things start to get a little dicey is one with subcontractors and Ill just give you an example subcontractors you cant come to my office in May and want me to file a lien for work that was completed in January if I ask you hey did you send notice and you say no I didnt send anybody notice

This is done by filing the proper documentary evidence with the applicable land title registry office. However, registration against the title is not required to preserve the claimants right to the lien. Simply providing the Claim for Lien to the property owner is sufficient.
A contractor might file a mechanics lien if a property owner reneges on paying a portion of the amount due for the work performed. A subcontractor could likewise file a mechanics lien if a primary contractor fails to make proper payment for their work and materials.
In such cases, owners can seek to bond off a mechanics lien. In plain terms, this means an owner can seek to substitute a surety bond for the underlying property in a mechanics lien claim. Basically, the surety bond replaces the property as security for the claim.
Every mechanics lien in California must contain the owners name, a general description of the property and location, the name of the hiring party, a description of the work performed and the amount of money owed.
How does a Mechanics Lien work? Provide a pre-lien notice. A pre-lien notice informs the hiring party (and any other relevant parties) of your involvement in a specific project. Provide notice of intent to lien. Create and file the lien. Notify and serve the property owner. Release the lien or seek legal action.
Contractors, subcontractors, laborers, and material suppliers can file what is called a mechanics lien on a homeowners property if they dont get paid.
Specific liens, on the other hand, apply to one specific asset. Mortgage liens, for example, are specific to the house you mortgage. If you were to default on the mortgage for your investment property, the bank could place a lien against that property, but would not be entitled to your primary residence.
Pursuant to Civil Code Section 8450, the mechanics liens priority is determined based on the date work was commenced. As such, even though the mechanics lien is recorded after the lenders deed of trust, it relates back to the date of commencement of the work and has priority over the lenders deed of trust.
