Pre-action protocols explain the conduct and set out the steps the court would normally expect parties to take before commencing proceedings for particular types of civil claims. They are approved by the Master of the Rolls and are annexed to the Civil Procedure Rules (CPR).
4.3 This Protocol ceases to apply to a claim where, at any stage, the claimant notifies the defendant that the claim has now been revalued at more than the Protocol upper limit. 4.4 A claim may include vehicle related damages but these are excluded for the purposes of valuing the claim under paragraph 4.1.
Pre-action protocols for low value personal injury claims apply to cases where the value of a claim is up to 25,000 and where an accident happened on or after 31st July 2013. They are designed to speed up decision making so a dispute is resolved as quickly as possible.
1.6 The Protocol recommends that a defendant be given three months to investigate and respond to a claim before proceedings are issued. This may not always be possible, particularly where a claimant only consults a legal representative close to the end of any relevant limitation period.
The letter should contain the date and details of the decision, act or omission being challenged, a clear summary of the facts and the legal basis for the claim. It should also contain the details of any information that the claimant is seeking and an explanation of why this is considered relevant.
Failure to comply with a Pre-action Protocol will be taken into account in any court proceedings which follow. The defaulting party may be ordered to pay additional costs resulting from his failure. If he is awarded costs by the court, the amount may be reduced on account of his failure.
What happens after sending a Pre-Action Protocol Letter? If the Home Office have not responded within 14 days of receiving the Pre-Action Protocol Letter, you will then be able to lodge a Judicial Review.
