Before a landlord can start the eviction process, they must give the tenant an official written 7-Day Notice to Pay or Quit. The filing for eviction does not continue if the rent is paid within the 7 days. If they cannot pay and remain on the property, the landlord reserves the right to continue filing for eviction.
A Three-Day Notice is the most common and quickest way to initiate the eviction process if the tenant is deliquent in paying the rent. The majority of Evictions, called Unlawful Detainer cases are for nonpayment of rent.
There are 3 ways to deliver a Notice Hand deliver the Notice. This is when you, or someone else 18 or older, hands the Notice to one of the tenants. Give the Notice to another adult in the home or where your tenant works and mail a copy to the tenant. Post and mail the Notice.

A 72-hour notice must be triggered by a signed warrant of eviction from a judge, this only takes place through a landlord properly petitioning the tenants to court.
A property owner cannot end a valid tenancy without a cause in New York. If you do not have an eviction cause, you must wait until the lease ends before asking the tenant to move out.
If there is no written lease, the tenancy must be terminated by a 30 day written notice (see step 1 below).
Eviction Proceedings Building owners must notify the tenant that rent is late, what the balance is, and that, if not paid, the tenant will be evicted. Three days after notice is given or oral demand for the rent is made, the owner may file a nonpayment proceeding in Housing Court and serve papers on the tenant.
