A Corrective Deed is used to fix/correct an error on a California deed which has already been recorded. This type of deed does not create a new interest. The Corrective Deed will correct the deed document on the earlier transfer of interest.
Minor errors found in legal descriptions can be corrected by a curative notice recorded in the county public records. The legal description may state northeast when it really should have said north.
It is common for people to make mistakes on their deeds. Fortunately, in California, property owners can use a Corrective Deed to correct any error to a recorded deed. Errors should be corrected as soon as possible. Doing so will reduce setbacks in the transfer of real property later on.
Perhaps it describes the wrong parcel, or fails to reflect all land purchased in the sale. An error in a legal description of a property has consequences. It can affect taxes. As lenders extend loans based on a percentage of the propertys appraised value, footage mistakes can sink a loan approval.
The State of California allows property owners to correct their deeds using one of two ways: an affidavit or a correction deed.
A deed of trust must be: (1) in writing, (2) contain a description of the property being used to secure the loan, and (3) be signed by the trustor or the borrower. Under the Statute of Frauds, a transfer of an interest in real property must be memorialized in writing.
A deed of trust is a type of secured real-estate transaction that some states use instead of mortgages. See State Property Statutes. A deed of trust involves three parties: a lender, a borrower, and a trustee. The lender gives the borrower money. In exchange, the borrower gives the lender one or more promissory notes.
