A deed of trust, also called a trust deed or a Potomac Mortgage, is used in some states in place of a mortgage, a transfer of interest in land by a mortgagor-borrower to a mortgagee-lender to secure the payment of the borrowers debt.
In contrast, a trust deed involves three parties: a borrower (or trustor), a lender (or beneficiary), and the trustee. The trustee holds title to the lien for the lenders benefit; if the borrower defaults, the trustee will initiate and complete the foreclosure process at the lenders request.
Cancelling a Trust Deed A Trust Deed is a legally binding agreement, so it cannot be revoked at will. If you are unable to pay the instalments which your creditors find acceptable, your Trust Deed may fail.
