Updated October 7,2020: A null and void contract is a formal agreement that is illegitimate and, thus, unenforceable from the moment it was created. Such a contract never comes into effect because it misses essential elements of a properly designed legal contract or violates contract laws altogether.
Once both parties are agreeable to the terms, the buyer will pay the Option Fee to the seller, and the seller will sign the document. Once signed, the OTP becomes a legally binding document.
Set up an LLC as the buyer, not you as an individual. Then sell the LLC to the person that you would normally be wholesaling to for whatever your assignment fee would be. At closing, the buyer never changes, and there is no wholesale fee to hide.
