Exceptions exist; the TAA does not apply to the following: Acquisitions set aside for small businesses. Acquisitions of arms, ammunition, or war materials, or purchases indispensable for national security or for national defense purposes. Acquisitions of end products for resale.
The public interest exception applies when an agency has an agreement with a foreign government that provides a blanket exception to the Buy American statute.
The countries that are currently designated as qualifying countries are Australia, Austria, Belgium, Canada, Czech Republic, Denmark, Egypt, Finland, France, Germany, Greece, Israel, Italy, Luxembourg, Netherlands, Norway, Poland, Portugal, Spain, Sweden, Switzerland, Turkey and the United Kingdom.
The statute does not apply with respect to articles, materials, or supplies not mined, produced, or manufactured in the U.S. in sufficient and reasonable available commercial quantities and of a satisfactory quality.
In order to maintain TAA compliance with your GSA Multiple Award Schedule (MAS) contract, you must agree each final product you sell will have been substantially transformed in the United States or in a signatory country designated by the TAA, throughout the entirety of your contract term.
A product is TAA compliant if: At least 50% of its overall manufacture cost originates from the US or designated countries. The product has undergone substantial transformation in the US or designated countries.
There are exceptions to CICAs competitive rules and mandates. The CICA does not apply to: Orders placed under single-award requirement contracts or definite-quantity contracts. Orders placed under single-award indefinite-quantity contracts that were entered into pursuant to the provisions of CICA.
Examples of designated countries that are NOT TAA approved are China, India, Indonesia, Iran, Iraq, Malaysia, Pakistan, and Russia. It is critical for GSA Schedule contractors to understand substantially transformation and the Country of Origin for each product and service offered under their contract.
