What does patent assignment mean?

Assignment means a transfer by a party of all or part of its right, title and interest in a patent, patent application, registered mark or a mark for which an application to register has been filed.

What is the difference between patent owner and assignee?

The assignee is the entity that has the property right to the patent. Patents are property. The inventor and the assignee may be one in the same but an employee will more than likely assign a patent to a company. The assignment of a patent is independent from the inventorship.

Is assignor still liable after assignment?

The assignor normally remains liable unless there is an agreement to the contrary by the other party to the contract. The effect of a valid assignment is to remove privity between the assignor and the obligor and create privity between the obligor and the assignee.

Can a patent assignment be revoked?

Assignments made for value, or with consideration, are irrevocable. This means that the assignor cannot cancel or take back the assignment.

Does a patent assignment need to be witnessed?
