Written notice. Text message records have been subpoenaed for court cases. It is important to have everything in writing and text messages can and will become a source of written notice.
This is the case for written contracts, digital legal documents, or agreements over text, email, or other forms of communication. As long as these conditions are met, text messages and other forms of electronic communication are considered legally enforceable contracts in court.
You can: pay the full amount of rent that is overdue, move out voluntarily, make a rent payment plan or moving plan in agreement with the landlord, temporarily stop the eviction by filing for bankruptcy, wait for the sheriffs deputy to show up to your doorstep, or try to fight the eviction in court.
Contracts come in all shapes and sizes, so a text message can be a legally binding contract if it meets the specific requirements of a contract.
No. Text message, email, and voicemail are not appropriate ways to deliver an eviction notice in Texas. If a landlord gives notice in one of these manners, it can cause the landlord to lose an eviction case. Texas law states that the eviction notice must be given in writing and delivered following strict procedures.
It is my understanding - for renters with no written lease - it requires 30 days written notice. Verbal or Text message is not legal.
Some contracts may require that tenants are sent notifications by mail, in which case any form of electronic communication would not be considered a valid form of notification. However, in many cases, text messages are indeed considered valid.
Texts may be inadmissible hearsay, and in some cases, may be considered an invasion of privacy. Currently, then, text messages are potentially admissible in family law or divorce proceedings at the discretion of the judge, based on existing rules of evidence.
But are agreements made through text messages legally binding in Texas? As long as the text messages satisfy the necessary conditions required for a contract then the agreement can be enforceable.
And specifically in New York City, a landlord cannot evict tenants by text message, or tell them to vacate.
