Yes, this is an option. Cease and Desist Letters dont need to be physical. You can deliver them in many forms, including electronically or by a phone call.
Failing to comply with a cease and desist order means that the violator could pay civil fines or damages. In some cases, particularly those involving harassment, continuing harassing activities could result in jail time.
Even if the sender demands or requires action, cease and desist letters are not summons and complaints. The sender may threaten to file litigation if a response is not received, but the letter does not mean a lawsuit has been filed. Instead, the letter is a warning of sorts.
Cease and desist letters (and texts, emails, etc) are not legally binding.
So sending a cease and desist text to someone to stop them texting you is not legally binding; you will have to follow up with possible legal action after being advised by a lawyer, or you can talk to a local LE officer or local prosecutor about the unwanted texts.
You can serve it via mail, email, an attorney and, in some cases, in person. However you choose to serve the letter, keep a record of delivery and receipt by the offending party. If you are sending the cease-and-desist letter yourself, send it via certified mail so that you have a record of delivery.
We do not recommend that you embark upon drafting a cease and desist letter yourself. If you end up starting court action, your cease and desist letter will be very important and if not factually and/or legally correct could damage your case.
