coming off the holidays had some negotiations with buyer and seller going back and forth via text my recommendation lets get it out of the text into an actual written contract so that one of the parties can sign and then hopefully the second party signs so we get a deal text messages are great for some quick banter maybe a little back and forth But ultimately you got to get it in writing so that was my suggestion to the parties hopefully fingers crossed today we can get another I need to purchase late Christmas present would be nice

REQUIREMENTS OF A REAL ESTATE CONTRACT The contract must be in writing and there must be an offer and an acceptance of said offer. The contract must have mutual assent and legal purpose. The contract must identify all of the parties involved. The contract must identify the subject property.
Valid Contracts First, it must include a valid home purchase agreement in writing. Second, the contract must contain an offer from the buyer and an acceptance from the seller. Third, the purpose of the contract must be legal. Finally, it must include an exchange of things that have value, like money for property.
Required Elements of a Real Estate Contract To establish legality, a real estate contract must include a legal purpose, legally competent parties, agreement by offer and acceptance, consideration, and consent.
Essential elements of a contract an offer. an acceptance. an intention to create a legal relationship. a consideration (usually money).
There are four elements that are required for a legally valid contract: offer, acceptance, consideration, and intention to create legal relations.
But are agreements made through text messages legally binding in Texas? As long as the text messages satisfy the necessary conditions required for a contract then the agreement can be enforceable.
The moral of the story is that it is far better to seek legal assistance before you engage in any negotiation concerning real property, even an informal exchange of text messages. So can text messages form a binding real estate contract? Yes.
The bottom line is: Real estate contracts must always be in writing in order to be enforceable. While laws may vary from state to state, most states have a Statute of Frauds that applies. And in general, oral contracts are hard to prove and enforce, so it pays to have agreements in writing.
