- Hey guys, Clint Coons here, and in this video, I want to talk about the use of deeds, and put a little different spin on it that you may not be aware of, on how you can go about deeding your property without anybody knowing. Okay, lets get started. (lively rock music) All right, so heres the deal. If youve bought property before, you know what a deed, how a deed works, right? People get a deed, they transfer property to someone. You receive your deed if youve bought the property. You take that deed down to the county recorder. You record it right away. And now youre listed as the legal owner on title to that real estate, so the whole world at large knows. So a lot of people assume that in order to transfer title for a legally enforceable deed, you have to record it. Well, that is not the case. When youre transferring title to property, the recording aspect of a deed isnt necessary. Now, its important. Dont get me wrong, all right? You want to protect yourself against claims

As mentioned before, just because both parties are on a loan doesnt mean they own equal shares of the property. Unless they are joint tenants/have full joint ownership, its likely that only one of the borrowers in a joint mortgage has their name on the actual house title.
If you own a house, then you definitely want your name on the deed. A house deed is an important legal document that proves that you are the true legal owner of your house. It gives you certain title rights, such as the right to take out a mortgage, or to buy, sell, rent or transfer the house.
Yes, you can put your spouse on the title without putting them on the mortgage. This would mean that they share ownership of the home but arent legally responsible for making mortgage payments.
What Happens If Your Spouse Is Not On the Mortgage. If your spouse is not on the mortgage, they are not responsible for paying it. However, the mortgage lender can foreclose on the house if the mortgage is not paid.
There is only one way to have your spouses name removed from the mortgage: You will have to apply for a loan to refinance the mortgage, in your name only. After all, the original mortgage was approved in both of your names, giving the lender two sources of repayment.
To remove your own name from a mortgage, you and your co-borrower can ask the lender for an assumption or modification that would remove your name from the loan. If the lender wont change the existing loan, your co-borrower will need to refinance the home into a new mortgage.
While there are some good reasons to add your new spouse to your Deed, theres also a reason why you shouldnt. Ultimately, there is no right answer. When you put your spouse on the Deed to a property that you owned individually prior to marriage, you are creating whats called a tenancy by the entireties.
Answer: You can use an addendum to add or remove any Buyers and/or Sellers. Name the original parties at the top and add the names off anyone you are adding or removing in the body of the addendum.
