Home Inspections and Negligence Most home inspection contracts include whats called a Limitation of Liability Clause. That language states that no matter what the home inspector missed no matter how badly they messed up they are not liable for any damages in excess of the fee that you pay for the inspection.
Must California Sellers Commission a Home Inspection Report Before Making Disclosures? California law requires only that sellers disclose known defects, with no obligation to search them out or get expert eyes on the house, such as by getting a home inspection.
In Texas, contrary to popular belief, as of January 1, 2023, the Texas Property Code 5.008 Sellers Notice of Property Condition does NOT require disclosure of previous home inspections.
Texas law does not permit dual agency. A license holder may not represent both principals as a dual agent under the revisions to TRELA. Under the current law, a broker must agree to act as an intermediary in ance with the statute if the broker agrees to represent more than one party in a transaction.
An inspection will always find a problem with a home. Even new home constructions will have minor issues that need to be addressed. Not about getting all the fixes done. No seller is going to fix everything for you.
While sellers and listing agents should review inspection reports they receive on the property, a buyer and/or buyers representative cant force them to do that. Additionally, there is no requirement that sellers agree to or even consider amendments requiring the seller to perform repairs to the property.
