The law in the State of Texas requires that a child goes to school. In ance with the Texas Family Code 65.002 and the Texas Education Code 25.086, the Compulsory Attendance law states: The state of Texas requires that children who are at least six years old through their nineteenth birthday attend school.
The average school year is 180 days. So, your child can only miss 18 days of school or 18 days of a specific class (or 9 days if theyre on a semester schedule) before the 90% rule affects their class credit.
Home schooled students are exempt from compulsory attendance ing to Section 25.086(a)(1) of the Texas Education Code because home schools have been determined by Texas courts to be private schools for the purpose of compulsory attendance.
Code 25.095. If a student has unexcused absences on three days or parts of days within a four-week period, the district must send a warning notice to inform the parent that the student is subject to truancy prevention measures (TPMs). Generally, tardies are not considered absences.
25.093) If a warning letter is issued, the parent with criminal negligence fails to require the child to attend school as required by law, and the child has ten or more days or parts of days within a six month period, or three or more days, or parts of days within a four week period; the parent shall be charged.
School districts are required to notify parents of attendance requirements at the beginning of the school year. This notice must state that the parent may be subject to prosecution and the student may be referred to truancy court if the student is absent 10 or more days or parts of days within a six-month period. Tex.
Each teacher or other school employee in charge of students during that period shall ensure that each of those students remains silent and does not act in a manner that is likely to interfere with or distract another student.
Section 25.092 - Minimum Attendance for Class Credit or Final Grade (a) Except as provided by this section, a student in any grade level from kindergarten through grade 12 may not be given credit or a final grade for a class unless the student is in attendance for at least 90 percent of the days the class is offered.
