The Invention Secrecy Act of 1951 requires the government to impose secrecy orders on certain patent applications that contain sensitive information, thereby restricting disclosure of the invention and withholding the grant of a patent.
Patent protection is secured through the filing of an application with the Patent and Trademark Office. There are five basic types of patent applications: An original application, as the name implies, is not based on or tied to any other patent applications before the patent office.
The Secrecy Orders apply to the subject matter of the invention, not just to the patent application itself. Thus, the Secrecy Order restricts disclosure or publication of the invention in any form.
The person signing must insert his or her own signature between the forward slash marks, 1.4(d)(2)(i). The name of the person signing must be printed or typed immediately adjacent (i.e., below, above, or beside) to the S-signature, and be reasonably specific, so the identity of the signer can be readily recognized.
