There are good reasons to include a survivorship clause in your Will, for example, if Anna dies leaving assets to Bob and Bob dies 2 weeks later, if there is no survivorship clause then the assets will first go through Annas estate and then through Bobs estate, potentially two probate processes.
Normally when property is purchased jointly there is a survivorship clause, meaning that on the death of one of the joint owners, their share in the property automatically passes to the survivor(s).
However, one feature a tenancy in common does not have is a right of survivorship. Generally speaking, if there are multiple tenants in common and one owner dies, that deceased owners interest passes to his or her heirs.
Ohio law provides that a deed must show a clear intention to create a survivorship tenancy. The standard language in a survivorship deed transfers property to the owners for their joint lives, remainder to the survivor of them. It is important for owners to review their deeds to see if this language is included.
Joint tenancy has what is called right of survivorship, where, if one owner dies, the surviving owner takes all of the property, immediately upon the other owners death. No court action is necessary for the surviving owner to take the property.
Under the right of survivorship, each tenant possesses an undivided interest in the whole estate. When one tenant dies, the tenants interest disappears and the others tenants shares increase proportionally and obtain the rights to the entire estate.
Without a survivorship clause, then any gifts of the estate on first death would need to pass to the survivor before it can be distributed to any further beneficiaries. This will mean the assets of the first testator will be calculated for IHT on first death and again on second death.
A right of survivorship is a right given to one owner to inherit property on another owners death. As the definition implies, a right of survivorship requires at least two owners. If there is only one owner, then there is no other owner that can hold the right to acquire the property at that owners death.
