Make it clear in the letter that the offer is conditional upon receiving positive references for the candidate. Clarifying that the relationship is at-will helps reinforce the idea that the offer is just that an offer not a promise. Make sure you have proof of the candidates poor references.
Unfortunately, many companies have a strict policy of not providing references for former employees. In fact, some require that all reference questions are directed to the human resources department for review, at which time HR may only release job titles and the dates the employee remained on staff.
What to say: The company does not permit me to provide any references. I would only be able to confirm your job title, employment dates, and salary history. So it would be in your best interest to find someone else to provide a reference.
Legally, yes, you can contact references without permission and backdoor reference checking isnt illegal. The decision is up to you, but its highly recommended that you respect the candidates request not to contact certain references.
Use these steps: Thank them. Whether youre sending an email or making a phone call, thank the candidate for applying for the position. Explain that youre pursuing other applicants. Mention the strengths of the other candidate. Let them know that many qualified applicants applied. Encourage strong candidates to apply again.
A no reference policy usually means that a corporation has adopted the practice of not giving out information about current or past employees to recruiters and potential employers. Often times the only information HR or managers are allows to reveal is verification of employment with dates.
Your human resources department does not have to give references for former employees. There is no law that mandates this, and your company cannot get in trouble for refusing to comply with reference requests.
However, many employers are hesitant to do this, and human resources departments will often institute company policies that forbid employees from giving any references, beyond verifying an employees tenure dates at the company.
