Chapter 149 of the General Laws, 148C and 940 CMR 33.02 require that the employer shall provide a minimum of one hour of earned sick time for every thirty hours worked by an employee, up to a maximum of 40 hours of sick time in a calendar year.
Massachusetts laws 149, 148C and 148D Employees who work for employers having 11 or more employees may earn and use up to 40 hours of paid sick time per calendar year, while employees working for smaller employers may earn and use up to 40 hours of unpaid sick time per calendar year.

All employees of a covered employer are eligible for sick leave, including full-time, part-time, temporary, and seasonal employees. Sick leave begins to accrue on the employees first day of work. However, employees may not use sick leave until they have worked for the employer for 90 days.
There are no set rules about how often your employer should contact you while you are off sick, it all comes down to what is reasonable.
Vacation/sick-time policies The primary advantage of having separate vacation and sick-time policies is that in most states you dont have to pay an employee for unused sick time when they leave the company, unlike PTO policies that require payment for all time accrued.
The minimum requirement is either one hour for every 30 hours worked, or 40 hours per year. This is only required to be paid if there are 11 or more employees that work for the business. Unused sick days do not have to be paid out at termination.
